Privacy Policy
Bentley Financial Services Canada (“BFSC”), a division Porsche Financial Services Canada, provides financial services for vehicles distributed by Bentley Motors, Inc. BFSC respects your privacy and the trust that you have placed in us to protect it. This Privacy Policy (“Privacy Policy”) explains what personal information we collect, how we use and share your information, and how we keep your information protected. When our information practices differ from this Privacy Policy for a product or service, we will tell you at the time you sign up, apply, or when such a change is made.
All references to “BFSC”, “we”, “us”, or “our” in this Privacy Policy refer to Bentley Financial Services Canada, a division of Porsche Financial Services Canada. This Privacy Policy does not apply to any of our affiliates, other Porsche or Bentley companies, or Bentley Retailers.
In this Privacy Policy, “personal information” means information that can identify you such as your name, e-mail address, phone number, driver’s licence number, credit history, banking information and credit card number. Personal information does not include data that does not specifically identify you, such as anonymized or aggregated data.
By submitting a credit application, or by entering into a finance or lease agreement with us, you consent to the collection, use, and disclosure of your personal information in accordance with this Privacy Policy and the applicable terms of the credit application or agreement, all of which are subject to the applicable provincial and federal laws of Canada.
When you apply for credit through BFSC, we collect the information you provide in the credit application, including your credit history information from the third party sources referenced therein (i.e. Equifax Canada and/or Trans Union Canada). We also collect personal information when you contact or communicate with us, and when you enter into a finance or lease agreement with us.
We may also collect your personal information from our affiliates and Bentley Retailers. When available from commercially or publicly available sources, we may receive updated personal information about you, such as when you change your address, contact information, or demographic information.
When you enter into a finance or lease agreement with us, the vehicle that is subject to that agreement (each, a “Vehicle”) may be equipped with vehicle tracking and other technology. We use the Global Positioning System (GPS), a network of satellites that allows us to determine the location of Vehicles. This information may be transmitted to us (and stored for a limited time) to be used for a variety of important purposes. For example, we may use GPS data to locate a lost or stolen Vehicle, if we reasonably suspect fraudulent activity in connection with the Vehicle, to enforce our rights in the Vehicle, including in the case you default on your contract with us, (for example, this information may be used to locate the Vehicle if we exercise a right of repossession under our contract with you), or if we reasonably believe the Vehicle may be in peril (e.g. exported). If you allow your Vehicle to be used by other people, you must inform them of the information collected under this section, of how it may be used and disclosed, and obtain their consent to this.
We may use your personal information to:
- Evaluate your credit application to finance or lease a vehicle through us;
- Verify your identity and perform credit checks to protect against fraud, or when otherwise required;
- Provide products and services to you;
- Market and communicate with you regarding Bentley products, services, and/or events;
- Respond to your inquiries, comments, or postings;
- Improve and customize our products, services, and customer service offerings;
- Facilitate our internal operations such as enhancing our products and services, customer retention, and to conduct research and analysis to better understand our customers’ preferences;
- Protect our interest in the Vehicle, including preventing fraud, peril, or export;
- Process payments, collect overdue accounts, and other activities necessary for the administration and enforcement of your account;
- Investigate or settle accounts receivable, inquiries or disputes; and/or
- Protect the security and integrity of our business and our legal interests.
We may collect, use and disclose your personal information for legal reasons as we believe necessary or appropriate, including:
- under applicable law, including laws outside your province or country of residence;
- to process, handle or otherwise respond to claims for damages, including claims or demands for bodily injury or property damage;
- to enforce our policies and rules and the terms and conditions of your finance or lease agreement with us;
- to recover Vehicles, equipment or any monies due, such as through debt collection agencies;
- to comply with legal process and to respond to requests from public and government authorities;
- to protect our operations, rights, privacy, safety or property, and/or that of our subsidiaries, you or others; and
- to allow us to pursue available remedies or limit the damages that we may sustain.
BFSC does not sell or rent your personal information to third parties. We may share your personal information:
- With third parties that provide a variety of services on our behalf, including payment processing, communications, marketing research and analysis, advertising, identity verification, vehicle licensing/registration, credit checks and fraud protection services;
- With independent, authorized Bentley Retailers for customer care and retention, and marketing efforts;
- With members of our affiliated group of companies to verify the accuracy of your information on file or for promotional or other purposes;
- To comply with the law, a court order, or other legal process, or in connection with an investigation;
- As may be necessary to protect BFSC’s rights and interests, those of our affiliates and authorized Bentley Retailers, and our (and their) respective employees, customers, visitors, users, or any other person or entity;
- For internal audit purposes;
- To enforce our agreement(s);
- If we sell all or part of our business or if it is relevant to a business transaction;
- In aggregated or other non-personally identifiable form; and/or
- In accordance with your consent.
If you wish to opt out of any of the data sharing practices listed above, please contact us.
We use reasonable technical, administrative, and physical safeguards to protect your personal information from loss, theft, and unauthorized access, disclosure, copying, use, and modification. The protections we use depend on the sensitivity of the information. These measures include:
- Technical measures like encryption to protect sensitive information transferred over the internet;
- Employee privacy and security training;
- Restricting access to personal information by employees, affiliates, and service providers to those who need it to perform their respective function;
- Requiring our affiliates and third-party service providers to provide substantially the same level of protection as provided by BFSC.
BFSC retains your personal information only as long as necessary to fulfill the purpose identified when you provide your personal information to us or our third party providers, for any new purposes to which you have consented, or as required by law.
BFSC and its service providers may store and process your personal information outside of Canada. When a service provider is located outside Canada, your personal information may be processed and stored in a country whose laws vary from Canada’s (e.g. the United States, Germany), and where the government may compel the disclosure of your personal information under local laws.
Although we take care to secure your information, no amount of safeguards can guarantee absolute security. We encourage all Bentley Retailers to comply with applicable privacy laws; however, each Bentley Retailer is a separate, independent legal entity from BFSC and is solely responsible for its own compliance with privacy laws.
Our services are not intended for use by minors. If you believe we may have collected the personal information of a minor without parental or guardian consent, or in a manner not authorized by law, please contact us.
